Folks,
I cannot seem to find the section of the bill re: invalidation of pending applications, that is causing everyone so much heartburn. Someone referenced section 502(d)(2), however if I look on thomas.gov, that section of the bill is about per country limits. Can someone supply either a) latest version of bill text or b) correct section reference regarding current and pending applications?

I think most of EB3I and EB2I are missing one point.
EB3I didn't loose anything by the change in spillover policy few years back.
It is EB3-world who lost. Obviously EB2I and EB2C was on the gainers side.
EarlierSpillover EB1row->EB2row->EB3row->EB1I/C->EB2I/C->EB3I/C
CurrentSpillover EB1row->EB1I/C->EB2row->EB2I/C->EB3row->EB3I/C
(or to be more precise, it is currently EB1->EB2->EB3 since spill overs are not considering country based limitations)
Either way EB3I was last in the que. So nothing changed for EB3I or EB3C.
EB2I or EB2C on the other hand moved ahead of EB3row, that is very noticeable.
EB1I/C also moved ahead of EB2row, by this is not that noticeable, since all these categories were close to "current" either way.
In summary, you change the spillover whatever way.... EB3I is always going to be at the end of the line, least benefiting from any spill over.

I hope once DOS decides to change the spillover and give the extra visas to Eb3 (whoever ROW , India....). The ensuing discussions from from the self glorified EB2 crowd here would make for an entertaining reading. I would like to see how much they enjoy the predictions after that.

The most important thing that somebody can do for themselves is to take an appointment with your congresswo/man's office and talk to them. It is not that difficult. Just 1 hour of your time.

Our lawmakers are unaware of the issues that affect us and it is really upto us (each one of us) to educate them.
The most important thing that somebody can do for themselves is to take an appointment with your congresswo/man's office and talk to them. It is not that difficult. Just 1 hour of your time.

Because, till 2005 there were extra 100,000 (total 242,000 were issued) recapturd numbers available. Therefore, no one cared (DOS/USCIS) about AC21 law that removes country quota. EB2 were curren for all then.

hi people, i read all your comments about how the IV community feels about the DREAM Act, and how you guys dont know if it will benefit the children of legal immigrants that fall into a similar situation. Well i got good news for you people, i am a staff at Massachusetts Immigrant refugee advocate coalition and we had a talk with couple of staff from senators Hagel, and senator Lugar to confirm us which version of DREAM were they doing to introduce this week which most likely could be today or tomorrow. both staff members were positive that the version that will be introduce as an amendment to the defense bill will be word by word identical to S. 774 that was introduce early this spring. what this actually means is that this version of DREAM does not discriminate legal from illegal...... just wanted to clear all that out for you guys..... thanks

I think IV should lobby to have the DREAM Act applied to all children, whether legal or illegal.
I am a legal skilled immigrant, came her in 1995 and still in line for GC. My son aged-out 3 years ago, and daughter will age-out in a month. Both of them would be on path to GC and citizenship under the DREAM Act....only if they had come here as undocumented. The DREAM Act allows the benefit till age 30, whereas legal dependants age-out at 21. Why this discrimination against legal entrants?

Even bigger news is that "Other Workers" have become Unavailable for the whole world.
It furthers strengthens the theory that good number of 245i's are EW category and not in the regular EB3 category.
This hypothesis is further supported by the fact that all EB3 dates have been sustained above May 1st for a few months now.

As per the data, so far people with notice date (on 485) before sept 1st have got their FP notices (except few people). So, I presume if someone's case transfered back to NSC from CSC before spet 1 st, he or she should expect their FP notice soon.
Obviously, we are not going get our notices if there several people lined up with notice dates before our transfer dates.
This is just my logical conclusion, may be incorrect

This "AP already approved" so no interimAP(even for emergency) audiotape started since Middle of OCT from NSC IO and local IO's. My AP got LUD on Oct 11th and they said that your AP approved so dont bug us for a duplicate. Wait ... Wait .. Wait ... But how long ??
What do i do now ? I cant travel without this piece of sheet ( i mean paper)
According to my lawyer one should contact USCIS in case of non receipt of AP (Physical Papers) within a month from first LUD. During that call one should ask USCIS whether USCIS get AP papers back or not ( For whatever reason address change and/or wrong address etc.. not delivered to you). If USCIS receive those papers back then it will resend it upon verifying correct address with you and that is without any extra cost. To make this happen certainly you will have to either make frequent calls to USCIS or take frequent infopass appointments.Down the road if USCIS does not get AP papers back and you simultaneously do not get them, meaning if paper lost during transit, then you do have 2 choice..(1) forget about receipt of AP approval papers this time (2) Refile AP with new fee as USCIS did not get mail (papers) back.
