Even if I back date my marriage (as advised) , How can I get my future wife to USA?. I cannot get her on depend status as my H1-B (I believe) got canceled on approval of GC.
Issues I see,
1. The back date of marriage must match to my stay at India.
2. I did not visit India in the last one year.
3. I applied my I-485 in the August 2008 time. So (I must mention my marriage and dependents in the application). Which I did not . So this does not work.
See the troubles I have now.
P.S: I did not want to cheat USA Immigration Dept. Not a good practice
Let me know if there are any guanine ways.

If i were in your place, i would have arranged register marriage in july itself :) after seeing the august visa bulleting then apply for spouse I-485 on the 1st day of August 08. This solves 2 problems, the one currently u r facing and the other chance of applying I-485 for your spouse. Later, you cud have followed ritual marriage as arranged by your parents....

hi, just now both the faxes sent. one more small suggestion, correct me if i am wrong, also in addition to contacting the employers, can we contact good immigration lawyers like Berry Appleman and Leiden (www.usabal.com), rajiv khanna, murthy.com, sheila, aila.org, ohio immigration (www.immigration-law.com) etc and ask them to send this fax on their letter pads on behalf of IV. my 2 cents..

They need to make EB GC process a linear one, meaning that you file for labor, then I-140, and I-485 as soon as your first two stages are cleared. Concurrent filing process is a hit or miss. It doesn't make sense anymore when you've so much retrogression.
This linear approach will be good for USCIS for two reasons:
1. They will get constant flow of applications rather than all at once. Plus they can control it by regulating the flow of I-140 approvals.
2. They will be able to better predict the visa movement based on their inventory.
For people like me, it will be good for two reasons:
1. I'll enjoy similar EAD/AP benefits that most of the people enjoy who filed during July 07.
2. No more H1B stamping.

I got the scanned copy of the RFE of my wife's case from my attorney this morning, here are the details - "Need secondary evidence to demonstrate the claimed relationship..."
I had submitted the marriage certificate, but now they want more. Gurus, has anyone received something like this before, please suggest how this can be taken care of. Can someone point me to a sample affidavit, please?

A cautious sense of freedom. Suddenly a lot more opportunities opened up and more employers started to show interest. My Desi employer is suddenly on the receiving end and I dictate the terms. Yes, Still workiing with them after 6 months, but that was my own decision to stick with them. Leaving them next month for a 50% raise in salary :)
- What did you do on the day you received it?
I got up at 7:00 that morning of Dec 3rd, (starting dec 3rd my date was not current anymore) , still half asleep, checked my email and got the shock of my life --"Welcome notice sent..." checked it multiple times then woke up my wife and almost dragged her to the computer and made her read the emails with half closed eyes... Our town recieved record rainfall that day and all streets got flooded, so no work :) Went to a Thai place for dinner that night with another family who are very close friend of ours.
-How did the long wait upset your life?
The feeling of uncertanity was terrible. Had to deal with the employer on a daily basis. They sat on my paperwork for 6 weeks, made me sign a million agreements and still did not file my case in June even though my date was current. I was devastated on the morning of July 2nd and rest is very well known to everyone here.
-How did immigrationvoice help you during this long wait?
What can I say? IV took me from what I mentioned in my last point to where I am right now - Waiting for my paycheck with 50% more and above that without any doubts about it coming :)
- Would you like to continue your support to immigration voice and help others waiting?

After I heard from the Infopass IO that my case is all set and it is sitting in the NSC examination room, I have been trying my best to get my file to the attention of an IO at NSC. This is what I have done till now. Don't know if this would work. If not, what the heck?
1. Wrote to my state's senators
2. Wrote to Ombudsman
3. Wrote to my Congressman
4. Wrote to the President
5. Have opened a SR
6. My attorney is taking an Infopass appointment to see why it is stuck.
We 2004 guys are really out of luck. First BEC, then all these LC substitutions, July 2nd fiasco, and now this. Can't believe we got screwed in all the steps.

This is my first post so forgive if I am not in the right place,
But I have situation where in I need your inputs to decide.
I am working at a clients place and they willing offer me a full time position.
My Labor is approved Oct 2007 and Filed for I-140 receipt pending.
In this situation should I change my job or should I wait for I 140 to be approved or wait till I apply for I 485 , but as you know the priority dates have retrogressed for EB2 and I heard that they will be unavailable shortly.
I always wanted to get a full time right from my Masters but ended up as a consultant as I had to get my H1 done.
Please Advice!

IMHO "legally" exploiting the system is illegal. I don't blame the system because any system will have some flaws in them. I would rather blame people who take advantage of situations esp in scenarios like this. We all know how much time some people has waited here. We heard a story on Monday right? Have we already forgot that? IV's goals and objectives are clear on its home page. Here comes the OP, registers himself and comes up with his first post of Labor substitution and how to better himself. I don't see any thing wrong in pete getting fired up. This exact attitude is the result of 6500 members and not 25,000 or what ever.

If I was judging you I would have concluded that you support what the OP is doing and wouldn't asked you what your stand is. It depends on how you understand what I said. Those NASDAQ listed companies you were referring to might have substituted labors but I am sure they wouldn't charge X dollars for giving a better PD or deduct from payroll under some other miscellaneous stuff. Ok..., but can you tell me how they are approving cses for PD EB3'2003 or Any EB3 cases daily, when EB3 is 'U', do you have answer for this.
Since ther is plenty of approval going on everyday.
They are not following any PD for the last 3-months approval, I don't believe any rule they have.Now they are already under pressure , and the pressure started already.They have to clean up.I don't think they will wait untill next year June, since Election is on Sept'2008.

Employer is following up whether it can sent back. Anybody has any idea of any luck in this case, or has to wait till dates are current again?:mad:
