Pineapple .. you hit the nail right on the head. It is a misconception that everything is cool in India. There are a lot more problems than just your salary. Money is not everything . I think standard of living and less corruption , cleanliness and less crowd do count towards life.

outsourcing is a phenomenon that will slowly expand in scope beyond low-end IT jobs - but the larger issue is that overall economic activity, which was concentrated in a few cities around the world - like NYC, London, Singapore, Tokyo etc., is getting geographically distributed - today more cities/ countries have world class higher education schools, stock exchanges, hospitals, manufacturing companies, banks than ever before...as a result - starting with tier II and tier III cities and eventually NYC, Chicago etc -the pride of place held by many US cities is now going over to places like Mumbai, Jo'berg, East European cities, Brazil, Chinese cities etc......companies are choosing to list their stocks at hitherto unknown exchanges, people are travelling to India and Thailand to get medical treatment done and so on
obviously jobs of all kinds - not just IT jobs - move alongwith the shift in economic activity - and this is not just about saving labor costs - but about overall balancing of demand and supply for land, labor, capital and entrepreneurship.
So, those who have high skill adaptability, geographical mobility and a strong network of professional peers are likely to continue to succeed in this game...having a GC or not would become irrelevant sooner than we probably think..
A personal comment for hpandey - not sure where you live in US- but i cant imagine how living in 300sqft lofts in NYC or shabby NJ suburbs (for many of us) and doing all grocery/ laundry/ housekeeping/ NYC type commute on your own can be any worse than living in delhi or mumbai or bangalore with driver, domestic helps etc. :-)

Complaint to USCIS...I know of one such body shopper who did the same thing...sold one labor to 10 people...when the fraud was caught...the employer was arresetd and the remaining 9 people who bought the labor were deported out of US...u should get the labor bak in ur name....fight for it...if you think this may bring ur downfall....take down ur employer with u...

What reason did you give for declining this promotion? what kind of company is this ? how big ? would your salary increase ?
Maybe if you answer this, I could think of something..but as of now..if its a good company and you like it..explain to them the nitty gritties about how change in occupation, classification, salary etc would jeopardize your GC process...i can give more suggestions if you want to send me a PM..

Ignore the IOs, just talk to your Senator or Congressman. They will be able to help you out. I was stuck in name check for more than 3 years. My congressman did not help but the senators office had a namecheck cell and they help out with genuine cases. The person there helped me clear my name check in 2-3 months (talk, dont email, send certified letter with details after talking to them). Had i known this earlier I would have had contacted them earlier and would have gotten my GC in June 07. My lawyer sdid not allow us to contact the IOs for information and i suffered big time because of that. Based on my experience all i can say is be proactive.

The latest example of this kind of policy nose dive is in Arizona. A recent bill, "Support Our Law Enforcement and Safe Neighborhoods Act" (SB 1070), was passed by the Arizona State legislature and awaits the signature of Arizona Governor Jan Brewer. As the Governor ponders whether or not to put her signature on SB 1070, she should consider the potential economic impact of the bill, which would require police to check a person's immigration status if they suspect that person is in the United States illegally. This bill, if it becomes law, will likely affect not only unauthorized immigrants, but all immigrants and Latinos in general. Given the vital role that immigrants and Latinos play in Arizona's economy, and considering Arizona's current budget deficit of $3 billion dollars, enacting SB 1070 could be a perilous move.
At a purely administrative level, Gov. Brewer should take into consideration the potential costs of implementation and defending the state against lawsuits. As the National Employment Law Project (NELP) points out in the case of other states that have passed harsh local immigration laws, Arizona would probably face a costly slew of lawsuits on behalf of legal immigrants and native-born Latinos who feel they have been unjustly targeted. This is in addition to the cost of implementation. For instance, NELP observes that "in Riverside, New Jersey, the town of 8,000 had already spent $82,000 in legal fees defending its ordinance" by the time it was rescinded in September, 2007. Also in 2007, the county supervisors in Prince William County, Maryland were unwilling to move forward with the police enforcement portion of an immigration law after they found that the price tag would be a minimum of $14 million for five years.
More broadly, Gov. Brewer should keep in mind that, if significant numbers of immigrants and Latinos are actually persuaded to leave the state because of this new law, they will take their tax dollars, businesses, and purchasing power with them. The University of Arizona's Udall Center for Studies in Public Policy estimates that the total economic output attributable to Arizona's immigrant workers was $44 billion in 2004, which sustained roughly 400,000 full-time jobs. Furthermore, over 35,000 businesses in Arizona are Latino-owned and had sales and receipts of $4.3 billion and employed 39,363 people in 2002 - the last year for which data is available. The Perryman Group also estimates that if all unauthorized immigrants were removed from Arizona, the state would lose $26.4 billion in economic activity, $11.7 billion in gross state product, and approximately 140,324 jobs, even accounting for adequate market adjustment time. Putting economic contributions of this magnitude at risk during a time of recession would not serve Arizona well.
With Arizona facing a budget deficit of more than $3 billion, Gov. Exactly. God foribid we lose our jobs. Before and after this announcement we are one bad earnings quarter away from being shipped back home. Its hard to enjoy life with stress like this.

My suggestion to you is to keep an open mind, accepting that your circumstances aren't presently of your choosing. Once you acknowledge your stress and accept it, you will be in a better position to focus on other aspects of your life that you might be neglecting as a result of your stress - for instance, having fun.

I understand that there is lot of fear among applicants that USCIS might retrogress the dates interimly sometime in july due to the expected high volume of applications filing in the begining of july.
To minimize the chance of USCIS from taking any such steps, shall we all unite and file the applications on a specific date in july probably on 30th of july? This will accomodate all applicants...so that we shall all be winners and use this opportunity to our advantage instead of competing amongst each other...where only a few will be winners and others will be loosers.
This will also reduce the pressure among applicants , attorneys and doctors.
Can the AILA cooperate? Will there be unity amongst applicants to make this possible??? any ideas ??
It is not workable option. How can you ask and convince your attorney to wait till the end of month and file. It is really foolishness and stupidity. If something happens, everybody will suffer. So, start sending whenever your docs are ready and good to go. Since we got a month, all filings will be distributed to whole month, and nobody or media cares. If they receive all on a particular one day, then it will be in news unnecessarily. Then, everybody starts hating GC applicants like the way it is happening for H1Bs because of mass filings on Apr 2nd 2007.
So, please don't bring these ideas to forums for your personal benefit. If you are waiting on for some documents to end of next month, just you only wait, not all of us. We want to go and file. Most of us are already waited enough time to get a chance like this.

What make you think BCOM or BBA or BSC is less than any other Bachelor degree EB3 own labor guys have. I am not here to defend or oppose LS. But before you talk about people who are not from same educational background as you, you should come out of bottom of Rock you have been living and breathe some fresh air. I for one, who has BCom and able to get my labor and GC cleared without using any of short cuts. :mad::mad::mad:

since there are many knowledgeable guys here ..I had another question - is there a law which says how the spillover should take place ? i.e. EB2(W) should go to EB2(I) etc ? I wonder why they don't send the extra visa's to the category that is in the worst position ..EB3 - I in this case ?
Only ROW EB3 spillover can make it to EB3 India and as ROW itself is retrogressed, that will not happen.
However, if you check 2007 assignments, Eb3 India got over 10K visas, though the stipulated limit is around 3K.

I am in similar situation, I have already changed my job after 180 days of filing my 485 (140 approved) and working with a small consulting company. Currently where I am working client willing to hire me as a fulltime employee with the same titile and giving me the supporting letter with the same job duties mentioned in my LC (I have added few more technologies it).
Even my attorney says the same, no need to inform CIS - when we get the RFE we will see.
Can you kindly let me know all the documents I need to gather and what I need to request from new employer in order to submit AC21 bunch to CIS.

I am in similar situation, I have already changed my job after 180 days of filing my 485 (140 approved) and working with a small consulting company. Currently where I am working client willing to hire me as a fulltime employee with the same titile and giving me the supporting letter with the same job duties mentioned in my LC (I have added few more technologies it).
Even my attorney says the same, no need to inform CIS - when we get the RFE we will see.
Can you kindly let me know all the documents I need to gather and what I need to request from new employer in order to submit AC21 bunch to CIS.

Old Employer.

Debug, Script, Modify, Design, Test and document applications systems & solutions. Design and deploy the backup solutions. Deploy and maintain developed technology. Engaged in disaster recovery procedures. Used technologies Windows, Unix, Linux, LAN/WAN, MS SQL, MySql, VB & Shell Scripting, Dell PowerEdge Servers, Dell/EMC/NetA pp SAN Storages, Dell PowerVault Tape Libraries.
Note: I will be getting a offer letter from new employer, what all I need to mention in the offer, please help me.

Quebec is a bit more conservative than Ontario (mostly coz of Catholic influences). Montreal is a fine place and one would be able to get along without knowing too much French (anywhere else in QC it's a different story). If you have long term plans for Canada, it's a good thing to know French.. as bi-lingual folks are given preference is many jobs (even outside QC). Montreal has an image of not being friendly to non french speaking folks - hence many who migrate to Canada end up in Toronto. So that may be a competitive advantage for someone moving to Montreal!
