My friend's company is India recently applied for his L1B visa. He is scheduled to go for stamping next week. But, another company has already premium-filed his H1B petition and is expected to hear back from the USCIS anytime now.
Here's the question: if he gets his L1B visa first, can he later on try and get his H1B visa and enter the country with the H1 visa? Second, if he goes for H1B stamping with an L1 visa already in his passport, will it affect the visa officer's decision in issuing a H1 visa?
Please chime in if anyone has done this before or has any insight on this matter.

I am on H1 B visa. I want to change my last name. If any H1 B visa holder has changed his/her name in US, please let me know the procedure and probelms encountered during the process.
My second question is - I have valid H1B visa stamp on my passport, If I change my name, do I have to go out of the country to get my visa stamp again ?

Ooops... I posted my reply to the pic in the gallery! To reiterate here, I love this photo... the only distracting aspect is the deteriorating wall in the shadows on the left. I played with some creative cloning and removed it and quite liked the results. Other than that, the color, symetry and lighting all come together in a really compelling way. It's one of my personal favorites!

With the huge influx of AP and EAD applications - I am quite certain that the last thing on USCIS's mind was making sure that the LUD was kept updated for the 485 apps. The important thing is that you have your 485 receipt and that is the acknowledgment that they have recieved the application and its in order.

Winter 2008 HairstylesMy I140 (Bachelor degree, EB3, PD: Nov'04) was approved last month from my previous employer.
I completed my MBA in Jun'06 and joined another company; my job description has changed totally and I can't use previously approved labor for my new job. My new employer will initiate the process of labor, next week.
I checked with my previous employer and he informed me that he is ready to give me a support letter, if I want to go ahead and file I485 based on EB3 I140.
Questions:
Is it possible to file I485, even if we are not working with the employer?
Once I have filed I485 based on my EB3 I140, and if the application remains pending for next 6 months, is it still possible to port the PD (Nov'04) to the new EB2 based petition?

Also..somebody with good writing skills write 1/2 page letter..about 8 different formats and wordings...so we can print them out and gives us a list of senators address...each member can spend 37 cents...even better fedex these to senators asking for support on the Skil Bill...

Here is my situation, my PD is March 05 and my 140 is pending for the past 3 months. Do you guys think if I get my 140 approved by Premium processing it would increase my chances of 485 approval this fiscal year? BTW, as its obvious from my PD I will be filing my 485 in July, God willing.
