The USCIS has launched a newly revamped website (http://www.uscis.gov/portal/site/uscis). I am setting up this thread to help navigate and find information that was present on the old website but is difficult to find now.

I sent my application to vermont based on the USCIS answering system on June 30th that folks with approved I-140s should send 485 applications to the center where it was approved. Any ideas, if there is a problem with that and if the app gets transferred how much time it will take.

I Just learnt that the Name Check for my I-485 was processed under a different Alien number when it should be processed by alien number assigned in I-485 case. Since it was cleared under a different number (probably the one for I-140), I-485 file did not have this information and now they are getting it fixed. So when everything in my case is current, this came up right at the time when they will almost be getting out of visa #s. :(
I recommend you should all contact your service centers where your I-485 was filed and make sure that yoru name check is in process or got processed under correct alien number. If the service center refuse to provide any information, contact your congressman office and have them verify this information. You can find who is your local congressman by going to http://www.visi.com/juan/congress/.

Guys,
I am on L1 .My wife is working for a Indian s/w MNC and was earlier in L1.Once her project got over they sent her to India.She applied for vacation and came here on L2.During visa stamping the officer cancelled her L1 visa in passport.We applied for her EAD in July and are expecting to receive it in a few days.This is the first scenerio.
Secondly, we applied for 485/140/AP/EAD in the second week of Aug 07.No updates yet with regards to cheques/receipt notices etc.
We tried to contact her company's office here to look out for employment based on L2 EAD.But they mentioned that they wanted her to goback and come here again on her company visa.I really cant understand what is that for.
Now the question is
1.Is it safe for her to change to L1again and have visa stamped in India given our situation of GC.If so when.I mean after receipt notices/finger printing etc etc?
2.Any idea of y these companies doesnt employ their own staff who are in EAD.
Any one gone thru any of the above situations.?

My current AP expires on July 30, 2008. I am planning to apply for renewal in Jan or Feb 2008, which is 6 months prior to expiration. I understand that nowadays it takes more than 3 months for approval.
In case of emergency, Can I travel to India with my current AP while AP renewal petition is pending?.

I applied GC labor in Mar 2005 and After 140 approval and 485 is pending morethan 2yrs, i changed my employer by using AC21. After that i recieved a letter from USCIS saying that I-485 denial on May 25th 2010, then after we applied on MTR on June 10th 2010. I recieved an reciept on June 20th 2010.
Can i work now by using an EAD or i need to wait until get the approval on MTR please do advice and when i could get the response from USCIS. My EAd is going to be expire within a couple of months, i applied renewal and i got a reciept on I-765. Please help me on this, really appreciate your help.

This is not really a surprise and it's not because American doctors are in any way inadequate. if the dependent is planning to come back on AP and then start working on EAD, does it mean the primary applicant has to work on EAD or the primary applicant can still continue on H1.

After nearly seven months of battling Republican filibusters and controversial amendments on the Senate floor, Majority Leader Harry Reid (D-Nev.) said Friday he may seek to change Senate rules to make it easier to restrict amendments on the floor.
Reid said Rules and Administration Chairwoman Dianne Feinstein (D-Calif.) would be tasked with exploring what rules changes should be made.
Noting that there has been a "growing breakdown between the majority and minority in terms of how to get things done," Howard Gantman, Feinstein's chief of staff for the Rules panel, said the committee would conduct a "comprehensive review" and look at the rules on the germaneness of amendments and how long Senators have to review proposals before voting on them.
"Sen. Feinstein is very serious about looking at the vast range of amendments that are brought in at the last minute that are not germane," said Gantman. He added that the panel's focus would be on "how to better get things done."
Reid spokesman Jim Manley cautioned that Reid "has no intention of unilaterally seeking a rules change."
However, Minority Leader Mitch McConnell (R-Ky.) scoffed at the notion of limiting or restricting Senators' ability to offer amendments, which he likened to freedom of speech.
"Look, nobody's going to shut anybody up in the Senate," he said at a press conference Friday. "There's going to be robust debate. You can just write that down. And I understand Sen. Reid's frustrations, but we're not going to establish any speech police in the Senate - not now, not ever."
Reid apparently reached his boiling point Thursday night when Republicans used Senate budget rules to offer a number of non-germane amendments to a student loan financing bill.
"What went on last night was ridiculous," Reid said on the Senate floor. "We should change those rules. ... We will have to take a look at that."
Reid said Health, Education, Labor and Pensions Chairman Edward Kennedy (D-Mass.) and ranking member Mike Enzi (R-Wyo.) managed the student loan measure "very well until it ran into the rule that we have here that allows unending amendments on any subject forever, literally, before you get to final passage."
Because the higher education bill - by virtue of its status as a budget reconciliation measure - was immune to filibuster, Senate rules permitted unlimited amendments to be offered and voted on. On Thursday night, in particular, Senators were given only a few minutes to review the substance of some amendments before they were asked to vote on them.
As is customary with budget and reconciliation measures, Senators engaged in a long series of back-to-back votes, known as a "vote-a-rama," at the end of the debate. But Democrats said Republicans' insistence on having 14 non-germane votes - including six related to cutting taxes, three related to immigration and two related to terrorism - was excessive.
When Democrats pushed back with their own non-germane amendment expressing the Senate's opinion that President Bush should not pardon Vice President Cheney's former chief of staff, Scooter Libby, Republicans tried to force a vote on former President Bill Clinton's controversial pardons.
But before the Senate could vote on that, Reid asked that both the Libby vote and the GOP pardons amendment be stricken from the Congressional Record, and the chamber voted on final passage of the bill.
Manley explained: "These so-called vote-a-ramas are bad for the system, and they may lead to bad policy. As have leaders in the past, all Sen. Reid was doing was expressing his frustration at the Republicans' desire to score cheap political points at the expense of a good-faith effort to pass a bill that will make college education more affordable for more Americans."

If I-485 is filed improperly, the application can be rejected and we need to resend again, however if the date move back, we will be stuck for years again.
What are the basis on which USCIS will reject the application, when the lawyer apply the application, what kind of evidence we should be double checking in our side, so that we do not have any potential for rejection.
If the fees are correct, if the forms are signed, all the initial evidence is provided? These are good enough to guarantee the acceptance of application.

On a serious note, you just have to inform your (dependent's) employer and provide them a copy of your unexpired EAD. Thats it! The employer may require you to fill a new I9 form.

Applied for Non RIR labor during April 2004 under EB2 in Ohio. Employer changed address (in same city) and one year before. Last week I came to know that Dallas BEC closed my labor case since they didnot recd the 45 day letter response from my employer. My employer requested Dallas BEC (with proof of informing them the address change) last week to re-open my labor case to continue processing the labor approval. My employer says it's better to apply for a new PERM as a backup.
Can the IV members advise me how to proceed on this?
