My wife is right now on H4 and having her EAD which will be expiring in another 2 months. She is not planning to work. Currently I am woking on H1B, soon I will be joing another employer on EAD. My question is it necessry for my wife to renew EAD even if she is not planning to use it. Once I swith on EAD what need to be done for my wife.

My mother is a GC holder since 91. I came to US in 2002 on F1 and then H1 and now GC.
Will the fact that my mom was a GC holder and I did not use that impact my GC? I have answered all the questions correctly(true i mean) always.

I currently hold H4 visa. I got H1 approval (consular) this year. Now instead of applying by consular process (in London), I want to join my spouse on H4 and then apply for COS from within USA.
1. Can I do this?
2. If Yes, how? Which form do I have to fill ? Kindly detail the procedure with applicable costs.
3. When I later, travel outside US, do I then have to have H1 visa stamped in my passport?
4. If Yes, does this 1st visa have to be from home country or could be from Canada etc.?
P.S. I do not have any educational or work background in USA.

Hi,
My Priority date is Jun 2006/EB2 India. After the Aug bulletin I'm now afraid that my priority date might get current next month.
My concern is that I might be getting married in the near future and I don't want to deal with an immigration nightmare for my spouse. At the same time I don't want to rush a decision like getting married based on USCIS priority dates. Is there anyway I could delay my GC adjudication for 3-4 months to get some more time ...

Hi,
I got an LUD on my I140 on 07/28/07. There is no message change though. This I-140 was approved way back in Aug 2006. I have filed my I-485 etc on June 1st 07, and its in process. Does anyone know what doesn this LUD mean.

This Unique Id is good for everyone, T.N.Seshan was recommending this way back in 1988. but the Present Ruling party at that time never agreed because they cannot do hacking polling booths but now it is all very easy.. Guess what.... the EVM electronic voting machines! get rid of that first go back to ballot papers, see who wins and who looses and how people of India are enlightened about the politics. I got my H1-B visa on June 29, 2005 , I came to india on Jan 2009 . From Jan 2009 till now I have been staying in India , bcoz I was taking care of my new born daughter, now she is grown up and now I am planning to start working in US. Right now I got my H4 visa .
I came to know from someone that H1-B filing for this year was over in Jan 2011, so if I need to file a new H1-b , I have to file now and I will be eligible to work after Oct 1 this year. Is it true ? Is it not possible that a company files for a new H1-B under premium processing and I start working after 2 weeks of filing ? I don't want to wait that long(Oct 1) to work , I have few oppurinities coming up where I may get selected.
I have stayed in india from Jan 2009 till APril 2011. Now I am on H4 visa in US. Can I get a extension of my previous H1-B visa filed on June 2005?
I want to work ASAP.

I got my first H1B transfer through a lawyer. The lawyer charged $3500/- out of which approx $2500 has to be paid by the employer as per law the lawyers charges would be around 1000 dollars for some paper work.
My second H1B transfer costed be 1200 dollars as lawyers fee and all other charges has to be paid by the employer as per law.
Its best to get an immigration lawyer involved since you can have a peace of mind. There is no need of premium processing. Once you get the receipt you can join the other firm. You don't have to wait till the process gets completed.

I am working with a company in US on a H1B Visa. My Visa has been expired. I had applied for H1B extn thru my employer. Today I recd something is very unusual. I recd a H1B extn approval notice in one mail, and another mail with a RFE with the same receipt number as my receipt#.
Not sure what this would mean, Not sure what takes precedence. I know for sure, this is a unusual case. Let me know in this case what should I do. I have asked my employer to question USCIS on this, they will be doing their part tomorrow morning.
Let me know if someone has gone thru this experience. I am sure this is a one off scenario, but for sure there may be lot of helpful souls around who know how much pain it is for not having a valid I94. Personally I am going thru a tough time as my state has expired my driving license as my Visa has expired.
All help and advice is welcome with loads of wishes and good luck to all you there
