I just got my wife's h4 approval letter today but the I-94 does not have any validity period on it, its blank?? Moreover, We received two more i539 approval notices sames as my wifes without any validity period under my wife's name (Applicant)... beneficiary were for two kids age 9,11 totally different last names/Nationality :confused:
I will call them tomorrow, I was wondering if anyone else also had this experience, do we have to travel outside the country to get I-94 stamped? my H1B approval has not arrived yet but the status online says approved. Our old I-94 on the passport have already expired, will that be problem?

The second reason is fund raising. I have a fundraising goal of 5$00 this year ans starting out early will give me a higher probablity of meeting my goal or exceeding it. I am going to be writing letters to my friends/ family to contribute towards IV as early as next week. I will see if I can raise atleast 150 to 200$ by doing that. I am going to organize a summer BBQ and have a cover charge or put a donation box at the BBQ. I will see how much I can raise doing that. My third event will be around November. I was planning on partnering with some friends and baking some pie's, puff pastry's, Cookies, kebobs and selling them at a local farmers maket on a saturday. Hopefully I will raise more than $500 doing all these. This should be a fun filled year for me.

What about those "lucky" creatures who worked for a desi employer? Desi employer ALWAYS file EB2, regardless of wht the requirement is. It is only the legitimate companies that actually bother about the "requirement" to file an EB2.
Anyways, its a moot point to have this discussion, since its not helping anyone's cause.
its probably the other way around..... desi employers usually file in eb3 so that they can have a grip on their employee for longer period of time... other employers may sometime weigh in the merit of the application resulting in eb2......
btw, they r all legitimate companies.... there is no illegitimate company..... u may not like them..... that does not make them illegitimate..... u could ask guys at cisco, msft or any of the large companies..... they all luv working with tcs, infosys patni etc....

Sorry to hear about your aging out issue. I think there are more out there than anyone realizes.
My son aged out while I was waiting for labor cert clearance too. He is now 22 and has been in the US since was 14.
I hope and pray every day there will be some relief for our families.
Every now and then another case pops up here on immigration voice and I feel it entirely appropriate that this issue is put in with the aims of the group since it is a problem entirely created by the broken employment based immigration process.
Please listen to our voices core group and do not forget us. We are in the same queue as you all whose children benefit as derivative green card applicants, our children are just a little older when they came here and have become forgotten victims.

Recently I�ve read letters from Khabar readers complaining about the service and performance at the Indian Consulate in Houston, Texas. So, when I found out that the Consulate had cancelled (on a whim, it appeared!) publicly announced visa camps in the Atlanta area, I feared the worst. Canceling publicly announced visa camps and not even informing the Indian media in the area or the very organizations that help administer them seemed like the height of disregard by the Consulate for their clients.
The next day I learnt that the Consulate had outsourced the visa processing service to a professional company. Not knowing what to make of it, I was still nervous as I had less than a month to go (I was counting on the visa camp that got cancelled). Thankfully, my experience turned 180 degrees when I began my application process from the link provided on the Consulate�s website for their visa services contractor.
After filling out the form online, the system gave me an ID #. I sent my form and documents by overnight delivery and kept my UPS tracking number handy?just in case! To my surprise, the very next day I received an email acknowledging receipt of the application and an assurance that it�d be processed right away. I was still not convinced that it could be going so smoothly, so the next day I went to the link they sent me to track the progress of my application, and sure enough there were fresh updates on it informing me the status of the application. Exactly a week from the day I mailed the application, I received another email saying my passport/visa had been dispatched back to me, along with the shipping company�s tracking number.
I was thrilled with the speed and professionalism of the whole process and would like to compliment the Consulate in taking this most effective step of partnering with a quality visa service provider.

Thank you for the info...My PD is 03/25/2005...A lot of people filed for their RIR or regular LC in the 2nd quarter of 2005 (jan-march) trying to get ahead of new PERM, which was supposed to have greater chance for an audit. Last day of old LC was 03/28/2005 and thus the hike of PD's that quarter...the following quarter you didn't see many LC approvals until lawyers and applicants were confident enough that the PERM system in fact was working as expected to start filinf for new appls, and thus the fewer approvals
It's hard to get a good idea when so few people participate in the poll so I took the data available on and ran a few numbers.

Got RFE on e-filed AP for my wife. They probably lost photos and asked for new set. Just shipped the reply and photos back to TSC.
Hope that triggers something.
Last time, I got couple of soft LUDs on 07/24; 07/25; 07/27 on all our EADs and APs. Wife's AP has hard LUD 08/05 (when they issued RFE) and soft LUD 08/06 (when RFE was mailed).

I am sorry to hear that VISA was not yet issued to your husband and that consulate is giving them a hard time. I pray to God that they get the VISA ASAP.
I am curious to know - if your hasband went to the consulate for the first time for VISA stamping or he had expired US VISA on his passport and a valid I-797 form and if he went for VISA restamping.
I will be travelling to my home country and will be going to US consulate for my H1B VISA stamping with approved I-797 next month. H1b VISA stamp on my passport has expired and I am here in the 8th year of H1B.

I am sorry to hear that VISA was not yet issued to your husband and that consulate is giving them a hard time. I pray to God that they get the VISA ASAP.
I am curious to know - if your hasband went to the consulate for the first time for VISA stamping or he had expired US VISA on his passport and a valid I-797 form and if he went for VISA restamping.
I will be travelling to my home country and will be going to US consulate for my H1B VISA stamping with approved I-797 next month. H1b VISA stamp on my passport has expired and I am here in the 8th year of H1B.

I arrived at the Situation Room at about 1 pm on Monday.. didn't know anybody and nobody knew me so I was searching for a Core IV type look on anybody's face... Poor 'beenwaiting' was eating her late lunch at what seemed like a registration table and she noticed my dillema.. she promptly put her lunch aside and briefed me on the agenda and my meetings.. Thanks 'beenwainting'...
Next I remember was helping Sanjeev (can u PM me your handle?) with his tie and hurrying with Shivkanth and Sumita (can you PM me your handle too?) to a Senator's meeting. That Senator's staff knew the issues pretty well and it was fun to watch Shivkanth debate with her.
SriKondoji - it was nice meeting you. The reception and the rally next day were a great experiences. Finally I had some great Indian food at the Union Station with Indio0617, Pappu and Dr. Gupta (can u PM me your handle?)
All PA (Philly) members - let's plan on meeting over coffee sometime in the next couple of weeks.

The experience of attending the rally was therapeutic in a way... Day in and day out one is sucked in to the bubble of daily life, work, kids, family..... and on top of it, the thought of interminable wait for GC really burns you from inside. You know you have to go through it and you know there are thousands like you who are stuck too. And then one fine day, these thousand faceless online handles come to life together and in the nation's capital and actually march and meet the lawmakers. This has truly been a great experience.

I-140 Approved in Nov 2005
I-485 Filed for both my wife and myself in July 2007
EB2 porting
Started new process with same employer in September 2010
Applied PERM in Jan 2011 and got approved in 10 days
Applied I-140 in April 2011 and got approved in one week
Priority date recaptured and I-140 has the old priority date (Sep 2004) and same A# as previous one
Opened SR with USCIS on May 6th 2011
Informed customer service that my Priority date is outside normal processing time
Received an e-mail after couple of days "There are no visas available to process your I-485 application. Your priority date is EB3 September 2004 which is later that the cut-off listed on the visa bulletin for your preference. Thank you for your time. This inquiry will be considered closed."
Replied to the USCIS e-mail(tsc.ncscfollowup) attaching the I-140 copy and asking them to upgrade my case from EB-3 to EB-2
Got the magic e-mail on May 17th 2011 and also reply for my e-mail

They will still do all the work needed to approve your application even when it is retrogressed. But, they just will not issue the actual Green Card until the dates go past your PD again.
You can remain on H1 until such time or use ur EAD and renew it on a yearly basis. The choice is yours based on your circumstance.
