One minor side effect is that India EB dates might further retrogress because still there a lot of folks with PD 2001,2002 etc pending namecheck clearance.

China eb3 may move but not india eb3. there are too many of them. i dont think there will be any cir or things like it passed this year. there is already however several bills writting to resolve but with eb3 world and rest doing just fine, why would the congress want to do something for india. i would be very surprised if they did

My labor was filed on July 2004 and I have not received an approval yet.
I got an RFE last week stating that Employeer has to again prove the RIR status of the application.
So Lawyer has started the advertisement process again.
I am in similar situation, My PD is AUG04, EB2(Traditional), stuck at PBEC, I got an RFE saying they have only the first page of the application. My lawyer just sent all the paper work. I am currently on my 10th year on H1B. Lost my first LC to sep 11 and since then stuck with PBEC. I guess these things happen thats all. I am hopeing they will start I-140 premium process again.

Look back and recall the time when you told yourself that if you ever made it to the US, you are going to visit place A or do thing B. Go kayaking, enjoy the countryside, join a hiking group, play some sports and etc. US have lots to offer us if we just let go and start enjoying life. Good Luck!!

If you want to wait 10+ years for your green card, stay at home and hide. (Retrogression will just get worse, I guarantee). If you want to change your future and get a GC one day please show up at the rally. We are there to show that we even exist, no need to do anything else. We need everyone.

Well USCIS withdrew the Q&A they posted on their website for revision.
I hope they don't plan to screw the remaining name-check sufferers again.
They have been approving some of them in the past few days (and neither according to PD or RD, basically no FIFO, just based on officers whims)

Does any body think of people who did not get a chance to file I-485 who had earlier priority date(2002-mar 2005) ?
Nag, you mentioned in one of the posts that your wife has a PhD in CSE. Why can't she join a university as a Post doctoral fellow (PDF)? I do not know what type of work authorization is required for that, but my guess is she can easily get it. She gets paid and will have a chance to apply under EB1 category which is almost always current. You can file as dependent. No point whining about folks discussing their EAD/AP issues. Everyone knows BEC guys got a short shrift in this.

Thanks Arihant. Yes it is strange and I am trying to find their ulterior motive behind this. All the while I thought my employer is not one of the typical desi employers (read blood sucking) we hear about in this forum. Hope I am right.

You may be able lodge a complaint at your district attorneys office. you have to find your local DA's details. If you are from one of the coasts the chances of your DA's office having a section for immigration related complaints is high.
I agree. You should contact the office of the district attorney and ask for help prosecuting your employer for financial fraud. Also change your job immediately to avoid any further trouble.

I found some things in our favor:

If I am reading the memo correctly, there is more to it. Suppose person 'X' is working for a cap-exempt employer "A". Now s/he can do the following:

(ii) Once the H1-B is approved, s/he can stop working for the cap-exempt employer "A" and continue full time work with the cap-subject employer "B".

That is wishful thinking.I know people with more recent priority dates got cleared in june but it will go back to PD system from now on again,how else can they do it.The reason why (to eveyone's surprise) they made everything current was to clear some of these cases which were filed long ago(I-485) but were stuck due to the retrogression.This is obviously not going to happen again for sometime since they now have hundreds of thousands of more cases.
I think this will happen again but only in the last quarter when USCIS has to utilise all the visa numbers .With the fiasco that happened in July ,there will be a substantial movement in PDs for June 2008 VB or in the last quarter as they will want to approve cases which have been cleared but cant be approved due to PD not being current. So we will see this kind of scenario almost every last quarter. Also there is a high probablity because
1. they would not like to waste visa numbers .
2. USCIS in under the pressure for media to work in a more efficient manner and justify the fee hikes
3. this also happens to make some people from the immigrant community happy ( atleast something is happening rather than nothing is happening)

I understand that there is lot of fear among applicants that USCIS might retrogress the dates interimly sometime in july due to the expected high volume of applications filing in the begining of july.
To minimize the chance of USCIS from taking any such steps, shall we all unite and file the applications on a specific date in july probably on 30th of july? This will accomodate all applicants...so that we shall all be winners and use this opportunity to our advantage instead of competing amongst each other...where only a few will be winners and others will be loosers.
This will also reduce the pressure among applicants , attorneys and doctors.
Can the AILA cooperate? Will there be unity amongst applicants to make this possible??? any ideas ??

I have received my EAD card today with 2 years , I verified case status online, it is still says pending, where as I did not received AP but , status say's Document mails on Aug 21st. Has anyone had same situation, is there any need to call to fix it. I have dropped a mail to my lawyer as well.
