F1 is not an option. To get an F-1 you have to prove intent to move back once your education is over. Being married to a permanent resident its almost impossible to prove that. This is a very tough situation. H-1 and L-1 are options but that depends on her educational background and line of work. One thing i would recommend if you plan to continue your stay in US is apply for her visitor visa before your marriage if you have enough time before your wedding. Atleast she can come visit you if she gets a multiple entry visa. Once you are married you can kiss good bye to the visitor visa option too.
It is not advisable to lie in your application about the wedding. If they find you of comitting fraud they can give you a 3 to 10 year ban from entering united states depending on the seriousness of the fraud.

I do have very different experience. I never had any issues with the indian consulate. couple of months back I have sent the papers for my daughter's PIO card. With in two weeks I got the PIO in mail.
My experience has been very good, too.
I had family emergency and needed visa to travel to India. Entry Visa (they don't issue Tourist Visa to people of Indian origin) was issued in 1 hour. The staff was very helpful.

Are you planning to take action against attorney as well?
Even though it may not be illegal for him to not to respond to you, but it clearly proves that attorney is aware, that your life is being screwed by not filing 485.
I am sure there exists some ethical responsbilities for them too, Did you check with the Bar association helpdesk (or anyone there) where your attorney is registered?
Also, please post attorney's details also whenever you think its time to disclose

I don't care about LS. Almost all cases I know are fraud. Sometimes 2 guys got GCs on same labor(since they were not asking Original LC). Thank god USCIS banned LS.

As much I understand LS has let people jump in line, it was a provision that was available for people to seek green card legally. We in IV do not differentiate on members on what methods or case scenarios they use or have used to obtain a Green Card. We need all our energies to be focussed to support IV initiatives. We need to refrain from any language that introduces confusion or division within the community. Even though "freedom of speech" or opinions are encouraged, we absolutely cannot say anything we want and get away with it in a common forum, can we?:)

For me, my AP was approved (along with my wife and daughter) on Oct 1st 2006. My Notice date is Sept 10th. The LUD on AP was 10/04, which said that the approval was "mailed" on 10/02. Hwoever I recd it on 10/20 and I could see that it was mailed on 10/19 from USCIS office. So, atleast for APs, even the status shows that it's been approved and mailed as well, it seems that it's not the case. It's been taking couple of weeks to get them in hand. Hopefully this info helps some people who are still waiting for APs.
I also took an Infopass appt, as we didn't recv FP notices yet. I opened a SR, but nothing so far. It looks that I may not get before I go to infopass next week.

I left my previous employer more than 6 months back , he didnt paid me my final paycheck and i complained to DOL since 3 months...now wehn i asked for my W2 he said me to do whatever i feel and he is adamant at not giving it....moreover he said that his company has suffered losses worth 25K and his lawyer has sent a legal notice in this regard....and when i said how will we file taxes he says he wished for me to be out of status and go back.....
Since i have complained to DOL and also it is more than 6 moths since i left his organisation giving proper notice and have email confirmations, can he issue me legeal notice.....?please advice...
He is also saying that he has written to USCIS that I am fraud,....though I have been working in fortune 100 companies and now also working in reputed company and never lied for anything and was on project from day 1 since I came to States....? can USCIS cause problems for me in future...
Also, he seems to have closed his company..
Folks please advice....
You dont need W-2 for filing taxes all the time. As long you have paystubs and i shows howmuch you paid taxes federal and state..that is enough..Please go to HE block or any other CPA who can file taxes and he can help you..

usage of spill over must be based on demand estimates and cannot be an exact science.
removal of ROW spill-over must be in anticipation of the dam burst expected when the BECS finally cross pass the april 30 PDs ( ROW being a big majority of these applications).
We need to look at what the BECs are doing and where they are wrt apr 2001 apps. I believe they are almost past it or in the thick of it. there would be a 3-4 month lag since a lot of these guys are going through recruitment.
That will tell us whether we are seeing the worst or if it can get worse.

This is a very good news that I have heard since last July. I am not sure if MBA's will also be condidered as part of this bill. I have paid around $90 K from my pocket, to get my MBA from Duke.
If that is the case then I would recommend that anyone who has any kind of support from their employer (or even without it) should get a masters degree as soon as possible. This will not only increase our value but will also shorten the queue.... just my 2 cents.
Unfortunately MBA does not fall under STEM degree list.
Per the recent OPT extension rule announcement by USCIS, you can write to them as they are taking suggestions with the reasons why MBA should be included. It will be hard to pursue because it is difficult to show shortage of skilled workers with MBA skills needed in US, but you are welcome to send USCIS letters.

About 2 weeks back Murthy posted an article in it's bulletin "new AC-21 regulations expected soon" http://www.murthy.com/mb_pdf/050208_P.html which i believe was a result of some discussions USCIS had with AILA?
Now is this new AC-21 memo released today the one being referred to in the above mentioned Murthy bulletin? OR i should still hold my breath for more AC-21 changes coming from USCIS, so they can jeopardize status of people by changing their interpretation of laws every now and then? Anyone?
